法的效力的起止时限以及对其实施前的行为有无溯及力,即指法的时间效力。

(1)法开始生效的时间,指法从何时起开始发生约束力。

(2)法终止生效的时间,指法的废止的时间。

法的溯及力,指新法颁布后对它生效前所发生的事件和行为可加以适用的效力。关于溯及力的规定大体有这样几种情况:一是从旧原则,即新法没有溯及力。二是从新原则,即新法有溯及力。三是从轻原则,即比较新法与旧法,哪个处理轻些就按哪个法处理。四是从新兼从轻原则,即新法原则上溯及既往,但旧法对行为人的处罚较轻时,则从旧法。五是从旧兼从轻原则,即新法原则上不溯及既往,但新法对行为人的处罚较轻时,则从新法。

中国现时期主要采取从旧兼从轻原则,在特殊情况下采用溯及既往的原则。
